1. Definitions

  • “The Company” refers to Argyll Air Performance Testing, its owner, employees, agents, and subcontractors.

  • “The Client” means the individual or organisation commissioning the services.

  • “Services” refers to airtightness testing, airtightness pre-tests, EPC certification, and SAP calculations provided by the Company.

  • “Site” means the property or location where the services are performed.

2. Scope of Services

2.1 The Company provides professional services including:

  • Airtightness testing in accordance with BS EN ISO 9972:2015 and Scottish Building Standards Section 6 (Energy).

  • Airtightness pre-tests and diagnostic assessments.

  • EPC certificates in line with The Energy Performance of Buildings (Scotland) Regulations 2008 and related amendments.

  • SAP calculations for new-build compliance assessments.

2.2 Services are delivered with reasonable skill, care, and diligence, consistent with professional practice and applicable Scots law.

3. Service Area

3.1 Argyll Air Performance Testing operates primarily across Argyll & Bute, but services are available throughout Scotland subject to additional travel and logistical charges.

4. Client Responsibilities

4.1 The Client must ensure that:

  • The property is safe, sealed, and ready for testing.

  • All vents, openings, and trickle vents are prepared or sealed appropriately.

  • Power and safe access are available at the Site.

  • All necessary technical data (insulation specs, system information, etc.) are provided accurately.

4.2 Additional charges may apply for delays or re-visits caused by incomplete site preparation.

5. Compliance and Certification

5.1 All airtightness testing shall be undertaken in compliance with:

  • BS EN ISO 9972:2015

  • ATTMA TSL1/TSL2 technical standards

  • Scottish Building Standards Section 6 (Energy)

5.2 EPCs and SAP results are lodged via the Scottish EPC Register operated by the Energy Saving Trust, using the Company’s Elmhurst Energy accreditation.

5.3 The Company is not liable for subsequent regulatory failures if the building is altered post-test or if Client-supplied data are inaccurate.

6. Quotations and Pricing

6.1 Written quotations are valid for 30 days unless otherwise stated.

6.2 Prices exclude VAT unless expressly indicated.

6.3 Additional costs may apply for:

  • Remote or island travel

  • Multiple dwellings or phased visits

  • Re-testing due to preparation failure

7. Payment Terms

7.1 A 25 % deposit is required to confirm bookings.

7.2 Remaining balances are due within 14 days of invoice date, payable via the secure online payment portal linked in the invoice email.

7.3 Reports, test results, and certificates remain the property of the Company until full payment is received.

7.4 Interest may be charged on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 (as applied in Scotland).

8. Cancellations and Re-Scheduling

8.1 Cancellations made within 7 days of the scheduled test date will be invoiced in full.

8.2 Where a property is not ready for testing, the Client may reschedule at no additional cost.

8.3 Rescheduling must be requested in writing (email acceptable).

9. Liability and Insurance

9.1 The Company maintains or will maintain appropriate public liability and professional indemnity insurance at standard industry levels.

9.2 Liability for loss or damage is limited to the total fee paid for the specific service.

9.3 The Company shall not be liable for:

  • Consequential or indirect losses (e.g. project delays or penalties)

  • Inaccurate information supplied by the Client

  • Events beyond the Company’s reasonable control

10. Data Protection

10.1 The Company complies with the UK GDPR and Data Protection Act 2018.

10.2 Personal data will be used solely for service delivery, certification lodgement, and regulatory compliance.

10.3 Data are not shared with third parties except where legally required or necessary for accreditation and certification.

11. Force Majeure

The Company shall not be held liable for failure or delay arising from circumstances beyond its control, including severe weather, illness, transport disruption, or government action.

12. Complaints

12.1 Complaints must be submitted in writing to argyllair@workmail.com within 14 days of service completion.

12.2 The Company will acknowledge and respond within 10 working days.

12.3 If unresolved, the Client may refer the matter to the Company’s accreditation body, Elmhurst Energy Systems, for independent review.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the law of Scotland, and any disputes shall fall within the exclusive jurisdiction of the Scottish courts.

14. Amendments

The Company may update these Terms periodically. The latest version will always be available on the Company’s website. Continued use of the Company’s services constitutes acceptance of the latest Terms.

Acceptance

By booking a test or assessment with Argyll Air Performance Testing, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
